SUMMARY:

The “Stem Cell Freedom Act” authorizes physicians in Wyoming to recommend and perform stem cell therapy on patients, even if such therapies have not been approved by the United States Food and Drug Administration (FDA). The act establishes that stem cell therapy must be conducted under the oversight of an institutional review board and in compliance with current good manufacturing practices. It also allows health care insurers to provide coverage for stem cell therapy at their discretion. Importantly, the act prohibits the Wyoming state board of medicine from taking disciplinary action against physicians solely for their involvement in stem cell therapy, as long as their practices align with established medical standards.

Additionally, the act ensures that no state official or agent can deny patients access to stem cell therapy, and it clarifies that no private cause of action can be brought against individuals involved in the care of patients receiving stem cell therapy, provided they adhere to the act’s requirements and medical standards. The act is set to take effect on July 1, 2026.
