While many pro-family bills align with our mission, only a limited number can be designated as priorities each session to ensure effective and focused engagement.
SUMMARY:
The proposed joint resolution seeks to amend Article 1, Section 38(c) of the Wyoming Constitution to clarify the legislature’s authority regarding health care access. Specifically, it allows the Wyoming legislature to define what constitutes “health care” and to enact laws that regulate health care, provided these regulations are reasonably related to protecting the health and general welfare of the people. The amendment removes the language that previously required restrictions on health care access to be deemed “reasonable and necessary,” thereby granting the legislature broader discretion in this area.
Additionally, the resolution stipulates that only the legislature, and not the courts, will have the authority to define “health care” for the purposes of this constitutional right. It also establishes that any legislation regulating health care will be subject to judicial review under the “rational basis” standard. This amendment will be presented to the voters of Wyoming for approval or rejection in the next general election.
