SUMMARY:
The bill establishes new regulations regarding home-based educational programs in Wyoming, particularly focusing on individuals with certain criminal convictions and those under investigation for child neglect or abuse. It prohibits any person who has been convicted of specified offenses from administering a home-based educational program if they, or anyone living in their home, have been convicted of such offenses within the last seven years. Additionally, it mandates that individuals under investigation for child abuse or neglect must not commence administering a home-based educational program during the investigation period if advised against it by the local child protective agency.
The bill also outlines penalties for violations, classifying the administration of a home-based educational program in contravention of these new provisions as a felony, punishable by up to three years in prison and/or a fine of up to $5,000. Furthermore, it specifies that individuals currently administering a home-based educational program in violation of these new regulations must cease such activities by July 1, 2026. The enforcement of these provisions will primarily fall under the responsibility of the department of family services or local law enforcement agencies.
