SUMMARY:
The proposed bill, known as the “Free Speech for Health Care Providers Act,” aims to protect health care providers from discrimination by state agencies based on their speech and expressions related to the provision of health care services. It establishes that no state agency can take adverse actions against a health care provider for engaging in protected speech unless it can be proven that such speech directly caused harm to a patient. Additionally, the bill mandates that health care providers must be notified of any complaints or actions regarding their licenses related to their speech within a specified timeframe, and it imposes fines on agencies that fail to provide this notice.
Furthermore, the bill allows health care providers to pursue civil action against state agencies for violations of their rights under this act, including seeking damages and injunctive relief. It also amends the Wyoming Governmental Claims Act to include provisions related to these protections. The act is set to take effect on July 1, 2026.
