Overview of Wyoming HB0064 (Enrolled Act No. 35)
Purpose:
HB0064 regulates chemical abortions by requiring an ultrasound before the procedure. The bill aims to ensure that pregnant women have the opportunity to view an ultrasound and hear the fetal heartbeat before proceeding with a chemical abortion.
Key Provisions:
Ultrasound Requirement:
- A pregnant woman must receive an ultrasound at least 48 hours before obtaining medication for a chemical abortion.
- The ultrasound must be of medical quality and provide an opportunity to view the fetus and hear the heartbeat (if detectable).
Verification & Documentation:
- The provider must document details of the ultrasound, including the date, location, and names of the ordering and performing healthcare providers.
- Before dispensing abortion-inducing drugs, a healthcare provider must verify that the ultrasound was completed.
Exceptions:
- The requirement does not apply in cases where the procedure is performed to:
- Save the life or health of the unborn baby.
- Remove a deceased fetus after miscarriage.
- Treat ectopic pregnancy or other life-threatening conditions.

Penalties for Violations:
- Healthcare providers who fail to comply may face a misdemeanor charge, with penalties of up to six months in jail, a $9,000 fine, or both.
- Pregnant women are not subject to criminal penalties under this law.
Legal Clarification:
- If this law conflicts with Wyoming’s Life is a Human Right Act or other existing abortion laws, those laws will take precedence.
Effective Date:
The law takes effect immediately upon completion of the legislative process.
This bill strengthens regulations around chemical abortions in Wyoming by requiring ultrasounds and documentation before the procedure, reinforcing the state’s existing abortion laws.
